Article 5 has supporters and opponents. When I studied the most famous critic of Article 5 was Mr. J.K. Mikke: “Article 5 is a relic of communism, and in Roman law there was dura lex sed lex and volenti non fit iniuria. And so it should be.” There were similar opinions of lawyers, but balanced. I was on this side myself. My thoughts for today are this: According to revered Roman law, Spartacus was also killed, Christ was crucified, and people were thrown to devour lions. Rome fell (Nietzsche ended up as a luntatic), and in European civilization hillel survived, who summarized all the teachings of Judaism in as long as anyone can stand on one leg: “Do not do to the other, which is not pleasing to you. All the rest comes from this.” That’s what Hillel said.

Article 5 is something similar. It has been the same as Equity in England since the 19th century: the Equity rule merged with common law. Article 5 is equity, which has become law. That’s where the British and American Empire grew up. Not like Rome, which fell into slavery, killed the Spartacus and Ave Caesar: morituri te salutant. Equity or Equity must be the Law.
