It is apparent from A.N. Whitehead’s thesis in ‘Process and Reality’ and from Mr Wittgenstein’s thesis in Tractatus Logico-Philosophicus that the dispute settlement system must follow the following pattern:
(A) distinguish between the structure of the facts observed (measured – evidence collected) and the structure of the language and logic in which the facts observed are described;
(B) distinguish between the structure of the facts observed and the structure of the facts as explained in the light of scientific theories and knowledge (it should also be borne in mind that the structure of language and logic and the structure of the facts are not the same);
(C) lay down rules according to which it can be determined whether ad B facts correlate appropriately with hypothetical facts described in the law;
The Polish system of teaching and dispute resolution does not meet this pattern on a fundamental level. The UK system meets it in 80-90%. I hope that these short remarks will draw the attention of outstanding Polish scholars in disputes and Polish philosophers of science and logic. I modestly hope that it will also draw the attention of the OIRP in Warsaw, whose current level of its members and staff is the pinnacle of the entire history of Polish law.
