Under UK law, equity maxims often contain the words “equity”. The list below contains the principles of the equity maxim in the UK law system and a possible equivalent in Polish law:
1. He who comes to equity must come with clean hands
Who comes to equity must come with clean hands
2. The principles of social coexistence may be invoked by those who himself
3. Equity does not suffer a wrong without a remedy
Equity does not allow harm without adequate remedy
4. Equity does not aid the volunteer
Equity does not support a person acting of his own volition (who does not want harm)
5. Equity looks at the substance not the form
Equity pays attention to the content and not to the form of
Agreements should examine the parties’ consistent intention and purpose and not rely on their literal wording
6. He who comes to equity must do equity (in future)
Who comes to equity must be willing to do equity
Whoever invokes the principles of social coexistence must be ready to respect them (in the future)
10. Equity will not permit the law to be used as an engine of fraud
Equity does not allow the law to serve as a means of fraud
