Prof. Szpunar explained to us in a lecture what is the difference between a securities and a legitimacy mark (a number in the changing room or a ticket to the cinema). The number in the locker room cannot be sold. The number is just a special PROOF that someone can pick up a coat suspended under an identical number. The securities are the same right and can be traded: they can be bought and sold. The legitimacy mark only “represents the law but does not replace the law as a securities”. Prof. Szpunar explained. Someone in the room remarked, “But after all, cinema tickets all resell each other.”
Then Prof. Szpunar replied: “Yes, but it is not legal. Such a practice exists because cinema has no PROOF that a person has “bought a ticket” from someone other than a cinema. The ticket cannot be resold effectively. The absence of EVIDENCE allows for the spread and existence of an unlawful practice.’ I mention these words when I wonder why the KPC Polish contains so many provisions designed to exclude or deprive man of his right to evidence and to the truth. Is a faster, but FALSE, result more important than getting to the TRUTH?
