I have been wondering for a long time: do you make a list of questions to the witness? I made such letters. However, when I was in the courtroom and could ask questions from my list, I noticed that at least half of my questions had already been answered by a witness with questions other than those on my list, and I had at most a few questions left that seemed irrelevant to me or redacted so that they had to be reformuled or were just stupid. For a long time I stared at my list and wondered how to reformulate the questions. It took a really long time and aroused the consternation of the court, the representative of the other party and even the witness himself. And even me. How is it possible that precisely because I wanted to do better, I fared much worse than the Judge and The Representative of the Other Party. I was inept like Danny Snyder from the movie “Sleepy” entangled in a list of questions that never led to any punchline.
