Before the witness begins to testify, the judge does two things: (a) instruct the witness on criminal responsibility and (b) receive the suing from the witness. The vow in American films is this: “I swear to God to tell the truth, the whole truth, and nothing but truth.” In polish court, the suing reads this (every lawyer should memorized him): “Aware of the meaning of my words and responsibility before the law, I solemnly sing that I will tell the truth without hiding anything from what I know.” I believe that the promise should always be made (according to the legislation, the witness makes it when both parties so wish). It happens that the party does not initially demand a suing, and during the testimony, when the witness says something unfavorable to her, only then demands a suing. And only then is it folded. This is being abused.
