It takes 2-3-5-10 years or more to hear the case.
The application for reinstatement of the time limit for lodging an appeal must be submitted within 7 days (together with the appeal) why not within 70 days. What is the point of limitation when so-called limitation periods lead to the loss of substantive rights even before the expiry of the limitation periods? An appeal must be filed in 14 days – why not in 140. All evidence must be reported already in the lawsuit – why not until after learning the response to the lawsuit and the information hearing of the parties and at least the key 2-3 witnesses.
The employee is liable for his mistake only up to the amount of 3 salaries. Why can an employee and anyone who makes a procedural error in court proceedings lose the property for which he is suing.
Is alleged adversarialism more important than truth and justice? Why can the offender be relieved of the obligation to make good the damage simply because the opposing party commits a procedural error. Are all these solutions right when the courts cannot apply the principles of equity that will allow these solutions to be corrected?
