In 9 out of 10 cases, the courts refuse to deal with any in-kind analysis of the expert opinion presented by the party. The best law will not do anything if we DO NOT KNOW AND UNDERSTAND THE FACTS AND ECONOMIC REALITY. And in addition – take pride in it. Each valuation of a property is based on some simple rules:
(a) what weight in the valuation we give to the individual parameters of the property (location, zoning status, etc.);
(b) on the basis of what number and what similar properties will be determined the price of 1 m2 for the property being valued (the key is the word “SIMILAR”);
(c) whether the weightings will be used to verify the price determined in accordance with points ad a and ad b.

The valuation rules are largely a task with a few unknowns at the level of the sixth grade primary school. This part must be subject to judicial review. The dispute is about facts more than about the law! The estimates drawn up on behalf of the municipality or the State Treasury are difficult to dispute in a court dispute with the municipality or the State Treasury. There is only one Representative in Poland who has 90% of the cases won: the Attorney General. I wonder whether this effectiveness is due to the superhuman competence of this Plenipotentitenti officer. And if not? Is it also the Rule of Law?
